<p id="isPasted">This Therabody Limited Warranty (&#x201C;Warranty&#x201D;) sets forth the rights and responsibilities between Therabody and the end-user purchaser (&quot;You&quot; or &quot;Customer&quot;) concerning the product(s) you have purchased directly from us and our authorized resellers. We encourage you to review this Warranty thoroughly to understand the terms and conditions under which your product is covered. Should you have any questions or require assistance, our Customer Service team can provide support and guidance. Please note that by using a Therabody product you are agreeing to be bound by the terms of this Warranty. For any warranty issues, please Customer Service team&#xA0;<a href="https://www.therabody.com/us/en-us/contact/" style=" text-decoration: none !important;">here</a>. All Warranty services must be authorized and performed by Therabody or a service provider expressly authorized by Therabody.<br data-uw-rm-sr><br data-uw-rm-sr></p><h2 id="warranty-period">Warranty Period</h2><p>Therabody warrants its products and accessories contained against defects in materials and workmanship when used normally in accordance with Therabody&#x2019;s published guidelines for the periods set forth below or otherwise listed on the product documentation (&#x201C;Warranty Period&#x201D;). The Warranty Period begins on the date of delivery to end-user purchaser. Therabody&#x2019;s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications. Certified Refurbished products purchased from Therabody will be further subject to the warranty terms set forth in the Certified Refurbished Product section below.<br data-uw-rm-sr><br data-uw-rm-sr></p><h2 id="limited-warranty-periods">Limited Warranty Periods</h2><ul><li>Devices: 1 Year Warranty</li><li>Devices (UK/EMEA): 2 Year Warranty</li><li>Attachments and Accessories: 90 Day Warranty*</li></ul><p>*Please note that accessories include charging cables, removable components of the devices, adapters, carrying cases, and charging stands.</p><h2 id="warranty-exclusions">Warranty Exclusions</h2><p>This Limited Warranty does not cover: (i) products purchased from unauthorized resellers or distributors; (ii) products that have been subjected to abuse, misuse, negligence, accident, alteration or accidental damage, including, but not limited to, contact with liquid; (iii) products that have been used for purposes other than those for which they were designed or intended; (iv) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship; (v) to defects caused by normal wear and tear or otherwise due to the normal aging of the product, including, but not limited to noise; (vi) any damage resulting from failure to follow product instructions, improper installation, or failure to perform routine maintenance; (vii) products sold &#x201C;AS IS&#x201D; or similar notions and does not cover consumable parts such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; ; (viii) unauthorized repairs or modifications; or (ix) if any serial number has been removed or defaced from the product. Any software is provided &#x201C;AS IS&#x201D; unless expressly provided for in any enclosed software limited warranty. When a product or part is exchanged, the original item becomes Therabody&#x2019;s property.<br data-uw-rm-sr>This Warranty does not apply to any non-Therabody branded products. Therabody does not warrant that the operation of its products will be uninterrupted or error-free. Therabody is not responsible for damage arising from failure to follow instructions relating to the product&#x2019;s use.<br data-uw-rm-sr>For Customers, who are covered by consumer protection laws or regulations in their country of purchase or, if different, their country of residence, the benefits conferred by this Warranty are in addition to all rights and remedies conveyed by such consumer protection laws and regulations, including but not limited to these additional rights. For a full understanding of your rights, you should consult the laws of your country, province or state.</p><h2 id="warranty-claims">Warranty Claims</h2><p>Therabody will replace any product that proves to be defective during the Warranty Period. To obtain warranty service, you must contact Therabody&#x2019;s Customer Service team here and follow the provided instructions for warranty claims. If a product is replaced under warranty, the original warranty period will continue from the date of purchase of the original product, not from the date of replacement.<br data-uw-rm-sr>Before receiving warranty service, Therabody may require that purchaser furnish proof of purchase details, respond to questions designed to assist with evaluating potential issues. If Therabody determines that the problem with the product is not due to a manufacturing defect due to materials and/or workmanship or the product is not properly returned to Therabody, or otherwise does not qualify for warranty replacement, then the purchaser will be responsible for all costs incurred by Therabody necessary to return the product. Unless otherwise instructed by Therabody, the product must be delivered, freight prepaid, in either its original packaging or packaging affording an equal degree of protection to the location specified by Therabody&#x2019;s Customer Service team. Please note all warranty returns must include the completed Return Authorization Form.<br data-uw-rm-sr>Therabody reserves the right to change the method by which Therabody may provide warranty service, and a product&#x2019;s eligibility to receive a particular method of service. Service will be limited to the options available in the country where service is requested. Service options, replacement availability and response times may vary according to country. Customer may be responsible for shipping and handling charges if the product cannot be serviced in the country it is in. For service in a country that is not the country of purchase, purchaser will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges.<br data-uw-rm-sr>If a claim is submitted to Therabody during the Warranty Period in accordance with this Warranty, Therabody will replace the product. In the event Therabody replaces the product, it will do so with a replacement product of the same model that is new or comprised of new and/or previously used Therabody parts and has been tested and passed Therabody&#x2019;s functional requirements formed from new and/or previously used parts that are equivalent to new in performance and reliability. Any replacement product provided under this Warranty may vary in the color and/or cosmetic design from the original product and may not include any original engraving or similar customization. Therabody reserves the right to replace any discontinued product with a new product of comparable value and function. A replacement product assumes the remaining warranty of the original product, or thirty (30) days from the date of replacement, whichever is longer. For international service, Therabody may replace products with comparable products and parts that comply with local standards.<br data-uw-rm-sr><br data-uw-rm-sr></p><h2 id="limitation-of-remedies">Limitation of Remedies</h2><p>Therabody does not authorize anyone, including, but not limited to, a Therabody reseller, agent or, to make any modification, extension, or addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.<br data-uw-rm-sr>TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. THERABODY DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE THERABODY&#x2019;S LIABILITY SHALL NOT BE GREATER THAN PURCHASE VALUE OF THE PRODUCT. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY.<br data-uw-rm-sr>In no event shall this Warranty require more than the replacement of any part or parts which is found to be defective within the effective warranty period. No refunds will be given. If replacement parts for defective products are not available, Therabody reserves the right to make product substitutions in lieu of replacement. This Warranty does not apply to any mobile device or the cellular and/or other network or system on which the product operates. Therefore, Therabody will not accept any responsibility under this warranty for the operation, availability, coverage, services or range of the cellular or other network or system. Therabody shall not under any circumstance be liable either expressly or impliedly, for any damages or losses of any kind whatsoever resulting from loss of, damage to, or corruption of, content or data during replacement of the product.</p><h2 id="therabody-certified-refurbished-product">Therabody Certified Refurbished Product</h2><p>Therabody warrants that Certified Refurbished products sold by Therabody will be free from defects in material and workmanship when used normally in accordance with Therabody&#x2019;s published guidelines for a period of 1- Year from the delivery date of the product to the end-user purchaser. Please note that Certified Refurbished products may show minor signs of use that affect cosmetic appearance, may not come in their original packaging, and non-essential parts or accessories may be missing (as identified on each individual product).
